An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the continued use of Allegheny County-owned land in Harrison Hills Park by Harrison Township as a leaf composting site.

Whereas Allegheny County is the owner of 468 acres of real property known as Harrison Hills Park (Allegheny County Real Estate Parcel 2021-G-86-0-2); and
Whereas The County, by and through its Department of Parks, is requesting permission to allow the Township of Harrison to continue to use a portion of Harrison Hills Park as a local leaf drop-off, processing, storage and pick-up site (hereinafter referred to as the “Site”) pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988 (“Act 101 of July 1, 1988”); and
Whereas the Site has been approved for composting by the Pennsylvania Department of Environmental Protection as per Authorization No. 797664/APS No. 696510; and
Whereas Harrison Township shall operate and monitor the Site in a manner consistent with Pennsylvania Department of Environmental Protections guidelines for leaf composting facilities. Activities include but are not limited to creating and turning of windrows, regularly checking compost temperatures and moisture levels, and permitting the Allegheny County Health Department to conduct routine inspections; and
Whereas Harrison Township agrees that Allegheny County may have the same rights and privileges as do participating municipalities affiliated with Harrison Township, at no cost to the County, with allowed activities including, but not limited to, deposit of loose leaves and pick-up of processed compost at the Site; and
Whereas County Council recognizes that the use of this property for the activities described herein will inure to the benefit of the citizens of Allegheny County; and
Whereas, Article IV, Section 2(k) of the Allegheny County Home Rule Charter vests County Council with the power by ordinance to lease, convey, vacate ...
