An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of the donation of walkthrough Garrett metal detectors from PSSI Stadium LLC for the use of the Fifth Judicial District of Pennsylvania - the Allegheny County Court of Common Pleas ("the Court") - primarily in the Magisterial District Courts (Magisterial Courts) within the Fifth Judicial District that can accommodate these metal detectors.

Whereas, PSSI Stadium LLC has expressed their intention and willingness to donate to the County for use by the Court fully operational walkthrough Garrett metal detectors that PSSI Stadium LLC has ceased using; and
Whereas, there are 46 Magisterial District Courts (“Magisterial Courts”) within the Fifth Judicial District that have the space to accommodate the walkthrough Garrett metal detectors; and
Whereas, the safety and security of the personnel and public working and appearing in these 46 Magisterial Courts would be greatly enhanced by having walkthrough metal detectors; and
Whereas, the Magisterial Courts have agreed to be responsible for the maintenance and operation of the donated walkthrough Garrett metal detectors; and
Whereas, Article IV Section 2(j) of the Allegheny County Home Rule Charter vests County Council with the power to accept by ordinance grants, gifts or donations of personal property on behalf of the County.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
SECTION 2. Acceptance of Donation of Metal Detectors for Use by the Court.
County Council does hereby authorize the County, on behalf of the Court, to accept the donation of walkthrough Garrett metal detectors from PSSI Stadium LLC made on or after October 1, 2023. The donated walkthrough Garrett metal detectors shall be placed in the 46 Magisterial Courts in the Fifth Judicial District that the Court determines can accommodate these metal detectors.
SECTION 3. Authorization to Effectuate Ordinance.
The appropriate County officers and officials, including but not limited to the County Manager and the President Judge of the Court, are authorized to take any and all such actions deemed necessary to carry out the intent and purposes of this Ordinance.
SECTION 4. Severability.
If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
SECTION 5. Repealer.
Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
SECTION 6. Effective Date.
This Ordinance shall be effective as of October 1, 2023.
