An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania amending the Section 5-1007.11 of the Allegheny County Code of Ordinances entitled Residency.

WHEREAS, since the time of its adoption in June 2020, the County’s Administrative Code has contained a provision generally requiring all persons employed in Allegheny County Government to be residents of the County or, if not a resident of the County at the time of applying for employment, to move to and live within the County within one year of appointment and acceptance of such employment; and
WHEREAS, County Council has amended the residency requirements, now codified at Section 5-1007.11 of the Allegheny County Code of Ordinances, several times in order to address the County’s need to hire persons with special skills needed for certain County positions; and
WHEREAS, the several amendments to the residency provisions in Section 5-1007.11 of the Allegheny County Code of Ordinances have utilized inconsistent language and terminology that could create confusion in the application of the County’s residency requirements.
The Council of the County of Allegheny hereby enacts as follows:
Section 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. Amendment of Section 5-1007.11 of the Allegheny County Code of Ordinances Entitled Residency.
Section 5-1007 of the Allegheny County Code of Ordinances is deleted in its entirety and the following is substituted in its place:
§5-1007-11. Residency.
A. Except as set forth in the subsections below, all persons employed in Allegheny County Government shall be residents of Allegheny County throughout their employment by the County.
B. An applicant for County employment need not be a resident of the County at the time of application. However, within one year of appointment to a position as a County employee, such individual shall be required to move to and live within Allegheny County.
C. Any person employed by the County who was not a resident of Allegheny County at the time of the adoption of the Administrative Code shall not be required to establish residency within Allegheny County to maintain his/her status as a County employee; but if such employee does establish residency within Allegheny County, that employee must maintain residency within Allegheny County throughout his/her employment with the County.
D. The residency requirements set forth in Subsections A, B and C of this Section shall not apply to the following:
(1) Staff in the John J. Kane Regional Centers.
(2) Staff in the Allegheny County Jail.
(3) Lifeguards in the Parks Department.
(4) Caseworkers in all County departments.
(5) Specific information technology positions in the County’s Department of Information Technology (or such successor County department providing similar services) that are currently being filled by contracted employees.
(6) Air pollution control engineers and coke oven technicians employed in the Air Quality Division of the Allegheny County Health Department.
(7) Staff in the County’s Emergency Communications/911 Center.
Section 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void, or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
Section 4. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
Section 5. Effective Date. This Ordinance will enter effect immediately upon its approval.
