An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, granting permission for the County of Allegheny to execute a 25-year Lease Agreement with Soldiers and Sailors Memorial Hall And Museum Trust Incorporated pertaining to the operation and maintenance of the Soldiers and Sailors Memorial Hall and Museum located at 4141 Fifth Avenue, Pittsburgh, PA 15213.

Whereas, the County of Allegheny (hereinafter referred to as “County”) is currently in a 25-year lease with Soldiers and Sailors Memorial Hall and Museum Trust Incorporated, a non-profit corporation duly existing under the laws of the Commonwealth of Pennsylvania; and
Whereas, Soldiers and Sailors Memorial Hall is operated and maintained by Soldiers and Sailors Memorial Hall and Museum Trust Incorporated; and
Whereas, Soldiers and Sailors Memorial Hall is the largest memorial in the United States that is dedicated to honoring all branches of military veterans and service personnel, in addition to being utilized as a venue for other purposes such as camps, graduation ceremonies, special events, etc.; and
Whereas, the Trust has been diligent in its operation and maintenance of the premises thus enhancing the value of the Soldiers and Sailors Memorial Hall and Museum to the County and its citizens; and
Whereas, due to the unique value that the site offers to the community, the County has provided funding to the Trust for decades as part of a lease agreement entered into with the Trust; and
Whereas, the current lease agreement is scheduled to end on December 31, 2025 and the County intends to enter into a 25-year lease renewal with the Trust;
The Council of the County of Allegheny hereby resolves as follows:
SECTION 1. Incorporation of Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. Authorization to enter into the lease renewal agreement
The County of Allegheny is authorized to execute the lease renewal agreement with Soldiers and Sailors Memorial Hall and Museum Trust Incorporated, with the lease renewal agreement commencing for a 25-year term on January 1, 2026.
SECTION 3. Severability.
If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.
SECTION 4. Repealer.
Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
