An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of twenty-six (26) parcels of land from Allegheny Land Trust located adjacent to the County’s North Park.

Whereas, Allegheny Land Trust is the owner of twenty-six (26) parcels land identified in the County’s Block and Lot system as 948-K-165; 948-K-178; 948-K-220; 948-K-234; 948-K-276; 948-K-281; 948-P-114; 948-K-176; 948-L-328; 948-P-298; 948-P-300; 948-K-212; 948-P-120; 948-P-302; 948-P-111; 948-K-246; 948-P-116; 948-K-280; 948-K-293; 948-L-292; 948-K-154; 948-P-124; 948-L-290; 948-K-223; 948-K-225; & 948-L-266 located in the Township of Hampton; and
Whereas, The County, by and through its Department of Parks, is requesting permission to accept the generous donation by Allegheny Land Trust of real property located contiguous to the County’s North Park. The Parks Department will incorporate the parcels into North Park where it will preserve the land and care for it as part of the park; and
Whereas, County Council recognizes that the donation of this property will inure to the benefit of the citizens of Allegheny County for recreational activities; and
Whereas, Article IV, Section 2(j) of the Allegheny County Home Rule Charter vests County Council with the power to accept donations of real property on behalf of the County.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
SECTION 2. Authorization to Accept the Donation of Real Property.
Allegheny County Council hereby approves the acceptance of the donation by Allegheny Land Trust of twenty-six (26) parcels of land identified in the County’s Block and Lot system as: 948-K-165; 948-K-178; 948-K-220; 948-K-234; 948-K-276; 948-K-281; 948-P-114; 948-K-176; 948-L-328; 948-P-298; 948-P-300; 948-K-212; 948-P-120; 948-P-302; 948-P-111; 948-K-246; 948-P-116; 948-K-280; 948-K-293; 948-L-292; 948-K-154; 948-P-124; 948-L-290; 948-K-223; 948-K-225; & 948-L-266 located in the Township of Hampton and adjacent to the County’s North Park.
The effective date of this authorization is the date this Ordinance is enacted and is perpetual.
The proper officers of the County are hereby authorized to execute all documents necessary to effectuate the authorization granted by this legislation.
SECTION 3. Effective Date and Term of this Ordinance.
This Resolution will enter into effect immediately upon its approval.
SECTION 4. Severability.
If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
SECTION 5. Repealer.
Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
