An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the continued use of real property in the County’s Deer Lakes Park for purposes of farming by Beacom Farms.

WHEREAS, Amy and Kevin Beacom are the owners of Beacom Farms, a cattle, sheep, chicken and crop farm located in Tarentum, Pennsylvania; and
WHEREAS, for more than thirty (30) years, Beacom Farms has leased from the County approximately eighty (80) acres of land in the County’s Deer Lakes Park for farming corn, soy beans, hay, and oats; and utilized four (4) structures for storing supplies and equipment and temporary housing of cattle; and
WHEREAS, the County’s Department of Parks has recommended that Beacon Farm be granted permission to continue to conduct farming activities on the eighty (80) acres of land in the County’s Deer Lakes Park and to utilize and maintain the structures thereon; and
WHEREAS, County Council recognizes that the Beacom Farms’ continued use of this property in the County’s Deer Lakes Park for such purposes will inure to the benefit of the citizens of Allegheny County through the application of sustainable farming practices, implementation of County-approved conservation procedures, and maintenance of farm structures; and
WHEREAS, Article IV, Section 2(k) of the Allegheny County Home Rule Charter vests County Council with the power to permit the use of County real property.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
SECTION 2. Authorization to Permit the Use of County Real Property.
Allegheny County Council hereby approves Beacom Farms’ continued use of approximately eighty (80) acres of land and four (4) structures in the County’s Deer Lakes Park for purposes of farming for a period beginning January 1, 2023 and ending December 31, 2025; provided however, that the proper officials of the County, with the consent of Beacom Farms, are authorized to extend Beacom Farms’ use of the property for farming purposes for an additional two (2) years until December 31, 2027.
The proper officers of the County are hereby authorized to execute all documents necessary to effectuate the authorization granted by this legislation.
SECTION 3. Effective Date. This Ordinance shall enter into effect as of January 1, 2023.
SECTION 4. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
SECTION 5. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
